Terms and Conditions
Welcome to the Community Gives campaign website, www.communitygives.org, which is operated by the eBay Foundation, an IRS Code 501(c)(3) nonprofit charitable organization located in San Jose, CA. The Community Gives campaign and our website are designed to facilitate individual charitable donations to our partner charities, the three nonprofit charitable organizations (Oxfam America, Best Friends Animal Society and First Book) supported in this campaign.
- Use. Please read these terms carefully when you access the Community Gives website. You acknowledge that you have read these terms and agree to be bound by them. To participate in Community Gives, you must be at least eighteen years of age and not a minor in your state of residence. If you are not eighteen years of age or older, or do not wish to be bound by these terms, you are not authorized to use Community Gives.
- Donations
- Tax Exempt Status. Each of our partner charities is a public charity recognized by the U.S. Internal Revenue Service (IRS) as tax-exempt under section 501(c)(3) of the Internal Revenue Code. Donations to these partner charities are tax deductible as permitted under U.S. law.
- Donations. eBay Foundation is donating $1 million to the partner charities and is asking the eBay Community to join in. eBay Foundation will donate an additional dollar, up to $100,000 in total, for each person who donates to the partner charities during the campaign. Community Gives enables you to make a donation to any of the partner charities through PayPal. Donations may be made with credit cards, bank accounts, buyer credit or account balances linked to your PayPal account. If you do not have a PayPal account, you can create one at no charge, when you make a donation. Any PayPal fees and transaction costs have been waived, so that one-hundred percent (100%) of your donation benefits your selected charity.
You may also donate money by listing items for sale through the eBay Giving Works program for charity listings. When listing an item on eBay, you can choose to donate between 10% and 100% of its final sale price to a partner charity (there is a $5 minimum donation if the item sells). eBay will provide a pro-rated fee credit depending on the percentage of the selling price donated to the partner charity. - Foreign Donations. While we do not actively solicit funds outside the United States, users from other countries will be able to make donations through the website using their PayPal accounts. The campaign does not solicit where prohibited by law. If you choose to make a contribution to any of the partner charities from outside the United States, please check with your local tax advisor on the treatment and deductibility of such contribution.
- Copyright. All content contained on the website is the property of eBay Foundation and its partner charities and is protected by U.S. or international copyright laws. You agree not to copy, distribute or modify the content contained on the website; except that you may print copies for your personal use, provided that you do not remove any copyright or trademark notices.
- Links. This website occasionally provides links to other websites. Because we have no control over such websites, you agree that we are not responsible for the availability or practices of such websites, including their privacy practices.
- Disclaimer of Warranties. Your use of the website is at your sole risk. The website is provided to you "as is," and eBay Foundation makes no representation or warranty of any kind to you, either express or implied. Specifically, eBay Foundation disclaims any implied warranties of title, non-infringement, merchantability, and fitness for a particular purpose. eBay Foundation is not responsible for any failures, delays or interruptions of the website or any viruses or other harmful computer code that may be transmitted from the website to your computer.
- Limitation of Liability. eBay Foundation is not liable for any loss or damage (including without limitation indirect, incidental, special, consequential or punitive damages) caused by your conduct, by your reliance on this website’s content, or by your use of this website. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for indirect, incidental, special, consequential or punitive damages. Accordingly, some of the above limitations may not apply to you.
- Indemnification. You agree to indemnify, defend and hold eBay Foundation harmless from any claim, expense or demand, including without limitation reasonable attorneys' fees, made by any third party due to or arising out of your breach of these terms or your violation of any law or the rights of a third party.
- Privacy. eBay Foundation treats your personal information in accordance with the Community Gives Privacy Policy, which is incorporated as part of these terms.

- Governing Law. You acknowledge and agree that these terms shall be interpreted, construed, enforced, and governed in all aspects in accordance with the exclusive jurisdiction and laws of the state of California.
- General. If any provision of these terms is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions shall be enforced. These terms set forth the entire understanding and agreement between us with respect to the website. These terms survive termination or expiration to the extent necessary to carry out the intentions of the parties. eBay Foundation reserves the right to modify, suspend, or terminate the campaign in its entirety at any time and for any reason in its sole discretion.
Community Gives Privacy Policy
- Collection. To donate and sign up for updates about the campaign or the partner charities you wish to support, you will need to provide certain personal information to us, including, among other things, your name, address and email address.
When you browse the Community Gives website, www.communitygives.org, we may collect some anonymous information about your use of the site, like computer sign-on data, standard web log information, statistics on page views, traffic to and from the site, and ad data (all through cookies – you can take steps to disable the cookies on your browser although this is likely to affect your ability to use the site). - Use. eBay Foundation uses the information it collects to operate and improve the website and administer the Community Gives campaign.
- Sharing. eBay Foundation shares some of the information we collect with:
- The partner charity you choose, so that it can provide you with a tax receipt, updates or other communications you choose to receive. You may opt out of receiving some of these communications by unchecking the relevant box in the Community Gives flow or by contacting the partner charity directly. We will not sell or rent your Personal Information to other third parties for their marketing purposes without your consent. - Security. We use lots of tools (encryption, passwords, physical security) to protect your personal information against unauthorized access and disclosure. However, third parties may unlawfully intercept or access information or communications. Although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.
- General. We may update this policy at any time, with updates taking effect after 30 days. If we or our corporate affiliates are involved in a merger or acquisition, we may share personal information with another company, but this policy will continue to apply. We delete personal information when we no longer need it for the purposes we described. We retain personal information as permitted by law to resolve disputes and enforce our policies.
